You're assuming that those states use the same definition.
2. "Firearm silencer" means any instrument, attachment, weapon or

the center line of the bore. Firearm does not include an antique
firearm.

Youll note that in the first section, theres no exception for "antique firearm", which I would put money on as to how NY courts will interpret it. NJ? The state that considers a bb gun a firearm? Thats a no brainer.

Saw an instagram or something similar where Silencerco is saying they aren't selling to people in the usual states because of possible legal problems for buyers. Pretty funny.
