TRO Does NOT Do Its Job, Victim Dies from Stab Wounds

Big friggin' surprise!!! Gee, a piece of paper doesn't stop someone intent on causing damage or harm to someone else. Now if you INTEND to kill or put someone else in a wheelchair for the rest of their lives, just how much of a deterrent would such a court order be ("Excuse me, could you please pass the latest court TRO or RO? My stall is out of toilet paper.")???
Ex-boyfriend arrested in fatal Escondido stabbing

ESCONDIDO — Escondido police have arrested a man suspected of fatally stabbing his ex-girlfriend's new boyfriend early Saturday morning inside a townhome on North Fig Street north of East Mission Avenue.

Shortly before 11 a.m. officers took Christopher James Selenak, 41, into custody in Vista without incident. Further details of the arrest were not immediately available.

Lt. Mike Loarie said officers received a report of a stabbing shortly before 4:30 a.m. The caller was a woman who told dispatchers that her former boyfriend, Selenak, had just stabbed her current boyfriend while inside her home.

The woman was calling from a friend’s home where she had run.

Officers forced their way into the townhome and found a man unconscious with a serious stab wound to his torso. Paramedics were called but were unable to save him.

The woman said Selenak had hurt her in the past and that she had recently obtained a temporary restraining order against him. Early Saturday morning she said she awoke, walked into another room, and saw Selenak standing near her boyfriend who was unconscious and covered with blood.

Police said Selenak also used the last name Selena.
That's why, even in their SUPREME stupidity of our democraptic-controlled legislature, they had a brain-fart and did SOMETHING a LITTLE BIT reasonable and created a protective provision for those who are in immediate danger and NEED to CCW (gotta' know your laws - WHICH THEY JUST RENUMBERED AND CHANGED, which is why I had such a damned-hard time trying to find the law I was looking for) - CA Penal Code:
25600. (a) A violation of Section 25400 is justifiable when a
person who possesses a firearm reasonably believes that person is in
grave danger because of circumstances forming the basis of a current
restraining order issued by a court against another person who has
been found to pose a threat to the life or safety of the person who
possesses the firearm.
This section may not apply when the
circumstances involve a mutual restraining order issued pursuant to
Division 10 (commencing with Section 6200) of the Family Code absent
a factual finding of a specific threat to the person's life or
safety. It is not the intent of the Legislature to limit, restrict,
or narrow the application of current statutory or judicial authority
to apply this or other justifications to a defendant charged with
violating Section 25400 or committing another similar offense.
(b) Upon trial for violating Section 25400, the trier of fact
shall determine whether the defendant was acting out of a reasonable
belief that the defendant was in grave danger.
Once in a while even the retards in Sacrakornhole get it right (SOMEWHAT), but it could certainly be a LOT worse!!
