They're never going to charge him with anything for this. The Pentagon's bread gets buttered by Congress, and the congressional shitstorm such a persecution would engender isn't worth the roasting and grandstanding that the members of the TN congressional delegation would inflict with glee on everyone from SecDef and CNO downwards, wearing track cleats, for the next 5-10 years.

What they'll actually do is issue him a non-punitive letter of stepping on his dick, which will almost certainly be intended to end his career at the 0-4 level.
Given that he's the OIC of the Chattanooga Navy-Marine reserve support base, this is not a guy who was gunning to ever be CNO anyways, so he'll probably respond with "Fuck them, I'll still probably make retirement in the reserves, even if I have to take a bust to CPO, and without any extra 7.62x39 holes in my ass." Which is a healthy outlook on his situation. And no offense to those of you in TN, but for a guy in the Navy, it's hard to think of a worse duty posting than a landlocked reserve base in the hinterlands, for punishment, so there's not a helluva lot else TPTB can do to the guy at this point.
(Noting as well that were he prosecuted, he could probably get Alan Dershowitz and Ted Cruz as defense counsels pro bono, who would tear some JAGholes a new ass with a backhoe, followed by defendant securing a $1M/yr military affairs commentator position with Fox News, win or lose. And he'd be a thorn in higher command's ass for the next decade. The Navy needs that sort of thing like they need to clean their crotches with a blowtorch.)

And there's a significant chance that if things roll over for a year and change, a new administration will hint none too subtlely that a personal decoration for gallantry is in order, and he might even get to make captain before he maxxes out.

Whereas the Hopey Dopey lame duck express, and sucking its ass, isn't going to get anyone promoted in the interim, nor do they have any private sector plums to dangle, thus there's precious little reason to be a dick about this, except for those already in authority who are spring-loaded to the asshole position by reason of their own DNA.

Meanwhile, a man on the street interview at Cal-Berkeley showed student after student saying this shooting was America's fault and we had it coming.
There must be an end to this intimidation by those who come to this great country, but reject its culture.

Shit, he would probably be picked as Cruz's running mate and used to slap the shit of the DNC for the next 5 years or more... Hell, after thinking about it, I would almost like to see it happen.
