New California Gun/Ammo laws

Post by John_in_Longview »

Via Instapundit, this link shows the new gun and firearm restrictions passed last night. Now, even previously purchased magazines with a greater than ten round limit must be surrendered. Plus there is a background check for ammunition purchases. The sad part is the new law was passed by 63% of California voters.

Storage unit businesses across the AZ and NV borders to boom.

Border state ammo sales sites to blossom and boom.

With these new laws in effect, can a proposition establishing an annual breathalyzer test for all drivers on June 13 to cut down on drunk driving be long in coming?
The use of the word "but" usually indicates that everything preceding it in a sentence is a lie.
E.g.:
"I believe in Freedom of Speech, but". . .
"I support the Second Amendment, but". . .

Sounds like a 4th, 5th, and 6th Amendment issue, along with an ex post facto law issue on the magazine initiative.
The avalanche has already started. It is too late for the pebbles to vote.

No ex post facto issue with the magazines, no one will be prosecuted for possession last year, but going forward, possession is illegal. There is no requirement that anything be grandfathered in.
Are you saying there is a self-incrimination issue for anyone other than criminals charged with some other crime so the issue of whether they have a "hi-capacity" magazine during the perpetration of the crime won't come up?
What sort of search and seizure or double jeopardy issue do you see?

The ammo thing will never survive the courts. The 9th circuit has already struck down less restrictive restrictions recently. That's why this was a proposition and not a law passed by the legislature, the legislature knows this will loose in court.

• If you want to buy ammo, you would now have to pass a background check through the DoJ and buy a 4-year permit that could cost $50 max.

• Selling ammo without a license would now become a misdemeanor. Hunters selling 50 rounds or less a month are still exempt.
No more 1yr license to sell ammo.

• Prop 63 would still require online purchases to be delivered to a licensed dealer and picked up in person, but it would move up the date it goes into effect to January 2018.
Instead of July 2019

• If Prop 63 passes, if a gun is stolen and worth less than $950, it would now be a felony.
Instead of a misdemeanor

• If you happen to still own large-capacity magazines from pre-2000, you would now have to dispose of them.

No more grandfathered standard capacity magazines.

• A court process would be set up to enforce the removal of guns from prohibited persons.
More mandatory enforcement now.

You know dont most gun owners in CA have unique priceless magazines that are high cap?

Btw can some one point me to the laws definition of ammo so i can see what components im allowed to send to CA?
