McArthur, Ohio Bans Weapons In Park - Hilarity Ensues

So this tiny town of about 1700 decides to pass an ordinance:

McArthur Village Council has voted to make Wyman Park a gun-free zone, recently passing an ordinance banning firearms and other "deadly weapons" from the area.
The ordinance states the ban will help "preserve the public health, safety and welfare" at Wyman Park, which the village owns and maintains. This ban prohibits all firearms, "whether concealed or not concealed."
McArthur mirrored similar Ohio Revised Code language outlining "deadly weapons" and "dangerous ordnances." Items other than firearms like explosives and ballistic knives are included in this ban.
The weapons ban is a minor misdemeanor and can include fines of up to $150 per offense.
The vote, conducted at a recent Dec. 16 meeting, was unanimous in favor of a ban (Councilwoman Misty Napier was not present). Mayor James Wooddell has also supported the ordinance.
Wyman Park hosts community events throughout the year and has been a regular place in 2015 for the village to celebrate its bicentennial.
Which appears to be in direct violation of Ohio law that preempts municipalities from doing exactly what they just did. And there is Ohio Supreme Court precedent to back that up:

I just found out about this. I am about 15 miles due north of McArthur.
I'll address this in the morning. If they don't want to do anything, I'll be open carrying in Wyman park in the early afternoon and, with any luck, I'll have a minor misdemeanor charge by the end of the business day.

MO preempts lower levels from imposing tighter restrictions, too.

And... why do they regularly celebrate their bicentennial in the park? How often does their bicentennial occur? :?

From the Ohioccw forum, it looks like Oberlin won their local level lawsuit and the council is now crowing that it stands as a precedent. In reality, it looks like a hometown court backed their buddies and they will lose on appeal. That will probably be the case with this village, as well. Oh well, that just means more attorney fees and damages their taxpayers will be paying! :twisted:

Yeah, we are all over this. Your friend is also my friend...once he gets the ticket some of us are planning to go have lunch in the park.

The only way to insure a park has no "deadly weapons" in it would be to bulldoze it flat, cover it with twenty inches of soft sand, and put up a fence to keep people from bringing their arms and legs in there.

If the McArthur council wants to ban stuff in their parks, they should start with THIS.

If the McArthur council wants to ban stuff in their parks, they should start with THIS.
